Terms & Conditions

Aysén Fjord Founder Expedition · Organiser Aysén Fjord SpA (Chile)

Last updated: March 2026

1. Introductory Provisions

These General Terms and Conditions (the "Terms") govern the rights and obligations between the organiser of the expedition and the expedition participant. They supplement the Expedition Participation Agreement; in case of conflict the Agreement prevails.

Organiser:

  • Aysén Fjord SpA, a company under Chilean law with its registered office in Coyhaique, Región de Aysén, Chile (company in formation; RUT and registered office will be added after registration in the commercial register)
  • Until registration, the Organiser is legally represented in Chile by the law firm Martínez & Núñez Abogados, Coyhaique (mnasesores.cl), which is its address for service
  • After registration, the Organiser is represented by Jaroslav Sokol, sole shareholder and administrador único (administrator)
  • Organiser's contact: office@aysenfjord.com · WhatsApp +420 722 288 191

These Terms govern the organisation of a private 12-day expedition to the Aysén Fjord in Chilean Patagonia (the "Expedition"). They apply to all participation agreements concluded between the Organiser and the participant. The participant's only contracting party is the Organiser; its administrator, shareholders and other engaged persons are not parties to the agreement.

2. Subject of the Agreement

2.1 Description of the service

The subject of the agreement is the organisation and provision of a private 12-day expedition into the inner Aysén Fjord in Chilean Patagonia for a group of 3–6 participants. Dates of the Founder Edition 2027: arrival at Balmaceda airport on 20 January 2027, departure on 31 January 2027; the exact dates may shift by no more than ± 2 days depending on flight connections and are confirmed by the Organiser in writing no later than 60 days before departure.

2.2 Price

The price of participation is USD 4,800 (four thousand eight hundred US dollars) per person. This is the founder price of the Founder Edition 2027; from the second edition the standard price is USD 5,800.

2.3 Included in the price

  • Organisation of the Expedition and its leadership by the expedition leader for its entire duration
  • All transfers in the Aysén Region from arrival to departure (vehicle, boat with a local captain and crew, full-day catamaran sailing into Laguna San Rafael)
  • Accommodation throughout: a private cabin on the vessel Patagonia I, cabins and campsites, at most two nights in a tent at a campsite with facilities
  • Meals (breakfast, lunch, dinner) including non-alcoholic drinks with meals
  • Entrance fees to national parks and reserves according to the programme
  • Satellite connection on the boat for emergencies, medical kit, safety briefing
  • Pre-departure group meeting in the Czech Republic (voluntary; by video call from abroad)

2.4 Not included in the price

  • International and domestic flights (incl. Santiago – Balmaceda)
  • Travel insurance (mandatory, see Section 7)
  • Personal equipment and clothing
  • Alcoholic drinks, personal expenses, tips
  • Optional activities beyond the programme (scenic flight, fishing) – arranged separately
  • Visa and other administrative fees, travel documents, vaccinations
  • Services not expressly listed in the Expedition programme

2.5 Framework programme and filming

The Expedition programme is a framework – the order and content of the days are adapted to the weather, the state of the sea and the captain's decisions. The Founder Edition 2027 includes the shooting of a documentary film about the region and the story of Václav Nový; a two-person film crew is therefore part of the group. Public use of footage in which a participant is recognisable is decided solely by the participant through their consent (Section 9).

3. Application and Conclusion of the Agreement

3.1 Application

By submitting an application via the website, e-mail or another form of communication, the participant expresses their interest in taking part. The application is non-binding. If the Expedition is fully booked, the application is kept as a waiting-list application; if a place becomes available, the Organiser contacts waiting-list applicants in the order of their applications.

3.2 Introductory call and personal selection

A place is confirmed after an introductory call (15–20 minutes). The Organiser may request additional information (health, physical readiness, motivation), verify the participant's fitness and, with regard to safety and the dynamics of a small group, decline participation. The participant usually receives a decision within 5–10 business days.

3.3 Conclusion of the agreement

The participation agreement is concluded by signing the Agreement (also electronically – scanned copy or recognised electronic signature) and takes effect upon payment of the deposit under Section 4. Until the Organiser is registered in the commercial register, the Agreement is concluded for the company in formation by Jaroslav Sokol as its founder, who guarantees to the participant up to the amount of the payments received; on the day of registration the rights and obligations pass to Aysén Fjord SpA, of which the participant is informed in writing.

3.4 Participant

A participant is a person over 18 years of age who has concluded the Agreement. Couples and friends apply individually; each place is per person and it is enough to note in the application that you are travelling together.

4. Price and Payment Terms

4.1 Currency

The price is agreed in US dollars (USD) and payable in USD. Exchange-rate differences and bank charges are borne by the participant. Another method of payment (e.g. EUR or CZK at the Czech National Bank rate on the payment date) may be agreed individually.

4.2 Payment structure

  • Deposit: USD 1,500 – due within 7 days of signing the Agreement; its payment secures the place
  • Balance: USD 3,300 – due no later than 90 days before departure (for departure on 20 January 2027: by 22 October 2026)

4.3 Method of payment

Payments are made by bank transfer to the Organiser's bank account stated in the Payment Plan, which the participant receives by e-mail after signing the Agreement. The Organiser confirms receipt of each payment by e-mail within 5 business days. Any change of bank account is always communicated by the Organiser in writing and verified by the participant by phone on the number stated in the Agreement before paying.

4.4 Late payment

If the participant fails to pay the deposit or the balance on time, the Organiser requests payment in writing within an additional period of at least 5 business days. After that period expires, the Organiser may withdraw from the Agreement; Section 5 then applies as if the participant had withdrawn on that date.

5. Cancellation Terms and Withdrawal

5.1 Full refund up to 90 days before departure

The participant may withdraw from the Agreement at any time without giving reasons, in writing (e-mail to the Organiser). If they withdraw more than 90 days before departure, the Organiser refunds 100 % of all amounts paid within 14 days, without deductions.

5.2 Cancellation fee after the 90th day

If the participant withdraws later, the Organiser is entitled to a cancellation fee of:

  • 89–60 days before departure: USD 1,700, which represents solely commitments to local partners already paid and non-refundable – USD 3,100 is refunded to the participant
  • 59–30 days before departure: 50 % of the price
  • 29–14 days before departure: 75 % of the price
  • 13 days or less, or no-show: 100 % of the price

The refundable part is returned within 14 days of receipt of the withdrawal. The decisive date is the day the written notice is delivered.

5.3 A stand-by instead of cancelling

Instead of withdrawing, the participant may transfer their place free of charge to another person who meets the conditions of participation and completes the introductory call. The Organiser may refuse the stand-by only for the reasons stated in Section 7 or for reasons of group dynamics, in writing and stating the reason.

5.4 Cancellation by the Organiser

If at least 3 participants have not confirmed 60 days before departure, the Organiser may cancel the Expedition; the participant then chooses an alternative date at the same price or a refund of 100 % of the amounts paid within 30 days. The Organiser may also withdraw if the participant has given untrue information about their health or readiness, or if their conduct endangers safety or trust within the group; in that case the amounts paid are refunded less demonstrably incurred costs.

5.5 Cancellation insurance

We strongly recommend taking out trip-cancellation insurance ("cancel for any reason") covering the cancellation fee under 5.2 in the event of illness, injury or another unforeseen event.

6. Programme Changes and Force Majeure

6.1 Changes for safety and operational reasons

The expedition leader decides on the route, the daily programme and safety measures; on the water, the captain of the boat decides. A change in the order of days, route or accommodation due to weather, the state of the sea or the health of a group member is a normal part of the Expedition and does not give rise to a right of withdrawal or a discount. What does not change is the scope: 12 days, a small group, the inner Aysén Fjord, the sailing to the San Rafael Glacier and the thermal springs.

6.2 Force majeure

Force majeure means an event beyond the parties' control – in particular a natural disaster, exceptionally adverse weather making sailing impossible for the whole duration of the Expedition, an epidemic, armed conflict, border closures or other government measures, a strike, or the insolvency of an air carrier.

6.3 Procedure in case of force majeure

If the Organiser cannot carry out the Expedition due to force majeure, it offers the participant an alternative date at the same price, or refunds within 60 days the amounts paid less the costs that cannot be recovered from local partners and that it documents to the participant. If force majeure occurs during the Expedition, the expedition leader adapts the programme; unused services are not replaced, but the Organiser refunds the part of the price it has demonstrably saved as a result. The Organiser does not reimburse the participant's costs of flights or other expenses outside the Agreement.

7. Insurance, Health and Physical Demands

7.1 Mandatory travel insurance

Every participant must hold valid travel insurance for the entire duration of the Expedition covering at least:

  • Medical expenses abroad – min. EUR 100,000
  • Rescue and evacuation from a remote area (including by boat or helicopter) – min. EUR 250,000
  • Personal liability

The participant provides the Organiser with a copy of the policy and the assistance phone number no later than 30 days before departure. Without valid insurance the participant cannot be admitted to the Expedition.

7.2 Physical demands

The Expedition is neither a mountaineering nor a high-altitude trip; it takes place at altitudes up to approximately 500 m. It requires walking sections of up to 5 km on uneven terrain (roots, mud, rocks), 3–4 hours of walking with breaks and coping with changeable, often rainy weather. As a benchmark: anyone who can climb ten flights of stairs without stopping can manage the Expedition. The boat part (at most 4 days) is physically calm. By agreement the programme can be adjusted towards greater difficulty or greater comfort; the agreement is recorded in writing in an annex to the Agreement.

7.3 Health

The participant declares that they are medically and physically fit to take part and completes a health questionnaire truthfully before signing the Agreement (chronic conditions, medication, allergies, mobility limitations). Changes in health before departure are reported to the Organiser without delay. Health data is shared only with persons necessary to ensure safety and deleted within 1 year after the Expedition.

7.4 Travel documents

The participant is responsible for a valid passport (valid for at least 6 months after return), any visas and for meeting the entry requirements of Chile.

8. Conduct of the Expedition, Risks and Liability

8.1 Participant's obligations

The participant respects the instructions of the expedition leader and the captain, behaves considerately towards the group, local people, their property and nature (Leave No Trace principles), does not consume alcohol in a way that endangers safety and does not use drones or other equipment in breach of Chilean regulations. The participant acknowledges that there is no mobile signal for approximately 4 days in the inner fjord; a satellite connection is available on the boat for emergencies.

8.2 Exclusion from the Expedition

If the participant, by a gross or repeated breach of their obligations, endangers their own safety or that of the group or the crew, the expedition leader may exclude them from the Expedition. The Organiser arranges transport to Puerto Aysén or Coyhaique; further costs are borne by the participant and the price is not refunded.

8.3 Risks

The Expedition takes place in a remote area without tourist infrastructure; staying on a boat, in the rainforest and in the field involves inherent risks (adverse weather, falls on uneven ground, hypothermia, limited availability of medical care – the nearest hospital is in Puerto Aysén). The participant accepts these risks to the extent permitted by the governing law.

8.4 Liability of the Organiser

The Organiser is liable for damage caused by a breach of its obligations under the Agreement; compensation is limited to the amount of the price, except for personal injury, intent, gross negligence and cases where the governing law does not permit a limitation. The Organiser is not liable for flight delays or cancellations, luggage lost by a carrier, refusal of entry into Chile or items left unattended. The participant is liable for damage caused to third parties or to the property of local partners.

9. Personal Data, Photographs and Video

9.1 Controller

The participant's personal data is processed by the Organiser as controller to the extent necessary for the performance of the Agreement, compliance with legal obligations and the protection of legitimate interests (safety). For participants resident in the EU, Regulation (EU) 2016/679 (GDPR) applies; for others, Chilean Law No. 19.628. Transfer of data to local partners in Chile is necessary for the performance of the Agreement.

9.2 Categories and retention

  • Identification and contact data, travel document – for the duration of the Agreement and statutory periods
  • Health data from the health questionnaire – up to 1 year after the Expedition
  • Payment data – for statutory accounting periods
  • Photographs and video – according to the consent given

Details and data-subject rights (access, rectification, erasure, restriction, portability, objection) are set out in the Privacy Policy.

9.3 Photographs and video

Photographs and video are taken during the Expedition for documentation and for a documentary film. Public use of footage in which the participant is recognisable (website, social media, film, print) is possible only with their consent; consent is voluntary, has no effect on participation and may be revoked at any time by e-mail with effect for the future.

10. Complaints, Governing Law and Disputes

10.1 Complaints

The participant reports defects in the services if possible immediately on site to the expedition leader so that they can be remedied; otherwise in writing to the Organiser within 30 days after the end of the Expedition. The complaint is acknowledged within 5 business days and resolved within 30 days.

10.2 Governing law and jurisdiction

The Agreement and these Terms are governed by the law of the Republic of Chile. The place of performance is the Región de Aysén. The ordinary courts of Coyhaique, Chile have jurisdiction over disputes, subject to mandatory rules of jurisdiction in consumer matters.

10.3 Consumer protection

The participant may lodge a complaint with the Chilean Servicio Nacional del Consumidor (SERNAC). If the participant is a consumer habitually resident outside Chile, the choice of Chilean law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence, and they may also turn to out-of-court dispute resolution bodies in that country.

11. Final Provisions

11.1 Effect

These Terms are effective from 15 September 2026 and apply to all Agreements concluded from that date. They replace the Terms effective from 1 March 2026.

11.2 Changes

The Organiser reserves the right to change these Terms. Changes are published on aysenfjord.com and take effect no earlier than 30 days after publication; Agreements already concluded are governed by the Terms as in force on the date of signature.

11.3 Severability

If any provision of these Terms is invalid, this does not affect the validity of the remaining provisions.

11.4 Participant's declarations

By signing the Agreement the participant confirms that they:

  • Have read and understood these Terms, the Framework Programme and the Expedition Briefing
  • Are over 18 years of age and have the capacity to conclude a contract
  • Know and accept the risks and physical demands of the Expedition
  • Hold or will take out the mandatory insurance and have completed the health questionnaire truthfully
  • Have been informed of the film crew in the group and that the use of footage is decided by their consent

11.6 Language versions
