1. Introduction

These Terms and Conditions (hereinafter "Terms") govern the relationship between [COMPANY NAME], a company registered in Chile with registration number [REGISTRATION NO.], with its registered office at [REGISTERED ADDRESS] (hereinafter "Provider," "we," or "us"), and any natural person who applies to participate in the Aysén Fjord Founder Expedition (hereinafter "Participant," "you," or "your").

By applying for or booking participation in the expedition, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms constitute the entire agreement between you and the Provider regarding your participation in the expedition.

2. Services

The Provider offers a 12-day private expedition to Aysén Fjord in Chilean Patagonia (hereinafter "Expedition"). The Expedition is designed for small groups of 3–6 participants and combines exploration, adventure, and nature immersion in one of South America's most remote and pristine wilderness areas.

What is Included:

  • 12-day guided expedition itinerary
  • All meals during the expedition (breakfast, lunch, dinner)
  • Accommodation (camps, lodges, or other arrangements as specified)
  • All required transportation during the expedition (boats, vehicles, hiking)
  • Professional expedition guide(s) and support staff
  • All specialized equipment provided by the Provider

What is Not Included:

  • International flights to/from Chile
  • Travel and evacuation insurance (mandatory)
  • Personal equipment (hiking boots, clothing, pack, etc.)
  • Pre-expedition medical examinations
  • Visa fees or travel documentation
  • Personal expenses, souvenirs, and tips

3. Application and Contract Formation

Application Process

Participation in the Expedition is subject to a selective application process. Your initial application constitutes a non-binding expression of interest. We review all applications based on experience level, physical fitness, group compatibility, and alignment with expedition values.

Contract Formation

A binding contract is formed only upon receipt of the Provider's written confirmation of your acceptance (email or written correspondence). Your acceptance is conditional upon:

  • Successful application review
  • Payment of the deposit (see Section 4)
  • Provision of required medical clearance and insurance documentation
  • Agreement to these Terms and Conditions

The Provider reserves the right to decline any application without obligation to provide detailed reasons. In such cases, any paid deposit will be fully refunded.

4. Pricing and Payment

Price

The total cost for participation in the 12-day Aysén Fjord Founder Expedition is USD 4,800 (four thousand eight hundred United States dollars) per participant. This is a founder price available exclusively for Q1 2027 expeditions (January–March 2027). All prices are quoted in USD and payment must be made in USD.

Payment Terms

Payment is divided as follows:

  • Deposit: 30% (USD 1,440) due upon confirmation of acceptance
  • Final Balance: 70% (USD 3,360) due 60 days before expedition departure date

Payment Method and Deadlines

Payment details and available payment methods will be provided in the acceptance confirmation email. Failure to pay the final balance by the specified deadline may result in cancellation of your booking and forfeiture of the deposit.

Currency and Exchange Rates

All prices are in USD. If you pay from a different currency, you are responsible for any currency conversion fees. The Provider is not responsible for fluctuations in exchange rates.

5. Cancellation Policy

Refund Policy

We offer a 90-day full refund policy with no questions asked. If you cancel your participation more than 90 days before the expedition departure date, you will receive a full refund of all payments made.

Graduated Cancellation Schedule

For cancellations made within 90 days of the departure date, the following refund schedule applies:

  • 60–89 days before departure: 50% refund of total payment
  • 30–59 days before departure: 25% refund of total payment
  • Less than 30 days before departure: No refund

To cancel your participation, contact us via WhatsApp at +420 722 288 191 or by email. Cancellation is effective upon receipt of your cancellation request.

EU Right of Withdrawal

Under Directive 2011/83/EU (Consumer Rights Directive), consumers in the EU have a 14-day right of withdrawal. However, pursuant to Article 16(l) of the same directive, this right does not apply to contracts for leisure services, including expedition participation. Therefore, the cancellation policy outlined above supersedes any statutory cooling-off period. By accepting these Terms, you acknowledge and accept this exclusion.

Refund Processing

Refunds will be processed to the original payment method within 14 days of cancellation confirmation. Please allow additional time for your bank to process the refund.

6. Changes to Itinerary and Force Majeure

Right to Modify Itinerary

The Provider reserves the right to modify, alter, or substitute any portion of the itinerary for safety reasons, adverse weather conditions, unforeseen circumstances, or other factors beyond our control. While we will make every effort to deliver the expedition as described, the safety and well-being of participants take absolute priority.

Force Majeure

Force majeure includes but is not limited to: natural disasters (earthquakes, floods, avalanches), severe weather conditions, pandemic or epidemic, government actions, war or terrorism, strikes, or any other event beyond reasonable control. In the event of force majeure preventing expedition operations:

  • The Provider will notify you as soon as possible
  • You may elect to (a) receive a full refund of all payments, or (b) reschedule for a future expedition date at no additional cost (subject to availability)
  • The Provider is not liable for any losses, damages, or expenses resulting from force majeure events

Expedition Cancellation

If the Provider must cancel an entire expedition due to insufficient participants or circumstances making the expedition unsafe or impossible, participants will receive a full refund or credit for a future expedition at their choice.

7. Insurance and Health

Travel Insurance (Mandatory)

Participation in the Expedition is conditional upon proof of valid travel and evacuation insurance covering medical emergencies and emergency evacuation from remote areas. Insurance must cover activities at high altitude and in wilderness settings. You must provide proof of insurance before expedition departure.

Cancellation Insurance (Recommended)

We strongly recommend obtaining cancellation insurance to protect against financial losses in case of personal emergency or illness requiring cancellation prior to departure.

Health and Fitness

The Expedition involves significant physical exertion, exposure to altitude, cold, and challenging terrain. You must be in good physical health and mental condition to participate safely. You are required to provide medical clearance from a physician confirming your fitness for expedition participation. Participants with pre-existing medical conditions must disclose them in writing prior to acceptance.

Assumption of Risk

You acknowledge that expedition participation involves inherent risks including but not limited to: altitude sickness, hypothermia, injury from falls or equipment failure, animal encounters, and natural hazards. By participating, you assume all such risks and accept responsibility for your own safety within the scope of reasonable precautions taken by the Provider.

Medical Treatment

In the event of medical emergency, you authorize the Provider to arrange evacuation and medical treatment at your expense (covered by your insurance) and consent to emergency medical procedures deemed necessary by healthcare professionals.

8. Limitation of Liability

Provider's Liability

To the maximum extent permitted by law, the Provider shall not be liable for:

  • Injuries, death, or property damage arising from inherent risks of wilderness expedition
  • Consequences of participant non-compliance with safety instructions or guidelines
  • Losses due to force majeure events, acts of nature, or government actions
  • Indirect, incidental, or consequential damages (including lost profits or reputational harm)
  • Damages resulting from third-party services (airlines, accommodations, guides)

Participant Responsibility

You are responsible for maintaining your personal safety, following all safety instructions provided by guides, and reporting any health concerns or hazards immediately. Failure to comply with safety protocols may result in removal from the expedition without refund.

Waiver of Claims

By participating in the Expedition, you agree not to hold the Provider liable for any claims arising from expedition participation, including but not limited to bodily injury, illness, property damage, or psychological trauma, except in cases of gross negligence or intentional misconduct by the Provider.

9. Privacy Policy and GDPR

Data Controller

We collect and process the following personal data:

  • Full name, email, phone number, nationality
  • Passport or identification details (for expedition logistics)

  • Communication records and correspondence

Legal Basis for Processing

Processing is based on:

  • Contract performance (GDPR Article 6(1)(b)) – processing necessary to fulfill the expedition contract
  • Legal obligation (Article 6(1)(c)) – tax and legal compliance
  • Legitimate interests (Article 6(1)(f)) – safety, emergency response, and fraud prevention
  • Consent (Article 6(1)(a)) – for marketing communications (optional)

Data Sharing

Your data may be shared with:

  • Expedition guides, staff, and support personnel (necessity for service delivery)
  • Medical professionals and emergency services (in case of medical emergency)
  • Payment processors and financial institutions (for payment processing)
  • Chilean authorities (for legal and immigration requirements)

Data Retention

Personal data is retained for the duration of the contract plus 7 years for legal and tax compliance purposes, unless longer retention is required by law.

Under GDPR, you have the right to:

  • Request deletion ("right to be forgotten") where applicable
  • Restrict processing
  • Data portability
  • Withdraw consent for optional processing

10. Complaints and Dispute Resolution

Complaint Procedure

We will respond to all complaints within 14 days of receipt. The Provider will investigate the matter and propose a resolution.

Alternative Dispute Resolution

For EU consumers, disputes may be submitted to the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. The Provider is committed to resolving disputes amicably and welcomes mediation as an alternative to litigation.

Governing Law

These Terms and Conditions are governed by the laws of the Czech Republic, without regard to its conflict of law provisions. This choice of law ensures clarity and consistency in legal interpretation.

Jurisdiction and Venue

Any legal action or proceeding arising from these Terms or expedition participation shall be resolved under the jurisdiction of the Czech courts. Both parties agree to submit to the exclusive jurisdiction of Czech courts for any disputes that cannot be resolved through alternative means.

EU Consumer Rights

Nothing in these Terms limits the statutory rights of EU consumers under applicable consumer protection laws. If any provision of these Terms conflicts with mandatory EU consumer protection law, the consumer protection law shall prevail.

11. Final Provisions

Entire Agreement

These Terms and Conditions, together with any documentation provided by the Provider (such as the itinerary, health questionnaire, and acceptance email), constitute the entire agreement between you and the Provider regarding expedition participation. Any prior agreements, negotiations, or understandings are superseded by these Terms.

Amendments

The Provider reserves the right to amend these Terms at any time. Changes will be communicated to participants via email. Continued participation in the expedition constitutes acceptance of amended terms. Amendments to cancellation policy or pricing will not apply retroactively to existing bookings unless participants consent in writing.

Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, the provision shall be severed. All remaining provisions shall continue in full force and effect.

Waiver

The failure of the Provider to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall it affect the validity or enforceability of any other provision.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the Provider's prior written consent. Any attempt to do so shall be void. The Provider may assign its rights and obligations to successor organizations or affiliated entities without notice.

Effective Date and Validity

These Terms and Conditions are effective as of January 1, 2026 and apply to all expedition bookings made on or after this date. They remain valid and in effect until amended or superseded by the Provider.
